Terms of Service

1. Acceptance of Terms

By accessing or using MedicalCode AI ("Service", "Platform") at medicalcodeai.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service. These Terms form a legally binding agreement between you and MedicalCode AI.

2. Eligibility

• You must be at least 18 years of age to use the Service.
• You must be a healthcare professional, medical coder, biller, or authorised representative of a healthcare organisation.
• You represent that all registration information you provide is accurate and current.

3. Description of Service

MedicalCode AI provides an AI-assisted medical coding platform that analyses clinical documentation and suggests ICD-10-CM, ICD-10-PCS, CPT, and related codes. The Service is intended as a decision-support tool. All suggested codes must be reviewed and validated by a qualified medical coding professional before submission to any payer or government programme.

4. Not Medical or Legal Advice

The outputs of MedicalCode AI are suggestions generated by artificial intelligence and do not constitute medical advice, legal advice, or compliance guidance. MedicalCode AI is not a substitute for the professional judgment of a licensed coder, physician, or compliance officer. You assume full responsibility for any codes submitted to payers.

5. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must promptly notify us of any unauthorised use of your account.
• You may not share your account or allow multiple users to use a single-seat plan.

6. Acceptable Use

• You may not use the Service to process data that you are not authorised to access.
• You may not attempt to reverse-engineer, decompile, or extract the underlying AI models.
• You may not use the Service to generate fraudulent codes, upcodes, or misrepresent services rendered.
• You may not resell, sublicense, or white-label the Service without our written consent.
• You may not upload malicious content or attempt to compromise the security of the platform.

7. Plans, Billing, and Cancellation

• Free plan — Limited weekly usage. No credit card required.
• Paid plan — Billed monthly as displayed on the Plans page. Prices are in USD and exclude applicable taxes. Your billing cycle starts on the day of payment and renews on the same date each month.
• You may cancel your subscription at any time. Access continues until the end of the current billing period, after which your account reverts to Free. No refunds are issued for partial periods.
• We reserve the right to change pricing with 30 days advance notice.

8. Intellectual Property

• The Service, including its AI models, interfaces, and underlying technology, is owned by MedicalCode AI and protected by intellectual property laws.
• You retain ownership of clinical notes and data you submit. By submitting data, you grant us a limited licence to process it for the purpose of providing the Service.
• Code suggestions generated by the Service are provided for your use; we make no copyright claim over them.

9. Confidentiality and HIPAA

If you process Protected Health Information (PHI) through the Service, you are responsible for ensuring you have appropriate authorisations and that your use complies with HIPAA and any applicable state privacy laws. Please contact us at legal@medicalcodeai.com to discuss a Business Associate Agreement (BAA) before submitting PHI.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any suggested codes will be accurate, complete, or compliant with payer requirements.

11. Limitation of Liability

To the maximum extent permitted by law, MedicalCode AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, loss of data, or claim denials, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amounts you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless MedicalCode AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that we reasonably believe may harm other users or the integrity of the Service. You may terminate your account at any time by contacting support@medicalcodeai.com. Upon termination, your right to access the Service ends immediately.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved by binding arbitration on an individual basis; you waive any right to participate in a class action.

15. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will provide at least 14 days advance notice by email.
